TRADEMARK, SIGN, BRAND REGISTRATION IN ROMANIA
The procedure for registering a brand (trademark) in Romania takes about 6–8 months.
Immediately after filing the application, temporary protection is granted, and final protection comes into force after the registration certificate is issued. A registered trademark is protected for 10 years, with the possibility of renewal every 10 years without limitation.
Free trademark check
We will carry out a free preliminary check to identify any already registered trademarks similar to your name.
Additional conflict check
If necessary, we can perform an in-depth search, including a list of identical and similar brands and an analysis of the risk of conflicts. The cost of this service is 850 RON + VAT, and the process takes 1–2 days.
STAGES OF TRADEMARK REGISTRATION:
1. Selection of classes of goods and services
We determine the classes of goods and services in accordance with OSIM requirements.
At this stage a fee of 680 RON + VAT is paid.
2. Preparation of the filing dossier
After choosing the classes of goods / services, we prepare the registration documents.
The official filing fees depend on the type of mark:
- 716 RON for a word mark (lettering);
- 855 RON for a black-and-white figurative mark;
- 1541 RON for a color figurative mark.
For each additional class, a fee of 249 RON is charged. Our legal services for registering one class are 1630 RON + VAT, and for each additional class – 95 RON + VAT.
3. Filing the application
We file the application for brand registration, which will be published approximately one week later.
Within two months from the publication date, an examination is carried out regarding the applied-for name and trademark.
4. Publication and issuance of the registration certificate
Approximately 7–8 months after filing the application, OSIM issues a decision on registration. If no oppositions are filed within two months from the publication of the decision, the state fee for issuing the registration certificate is paid – 249 RON – as well as 1300 RON + VAT for services related to forwarding the decision and monitoring the issuance of the certificate.
Important: additional costs may arise in the event of oppositions, notifications of refusal or appeals.
Required documents for registration:
- Copy of the company’s CUI / copy of the ID of the person representing the company and their position;
- Brand name / logo in JPG format;
- List of goods or services for which you wish to register the brand.
